ASSAULT FACTS AND REPERCUSSIONS

If a person intentionally or recklessly causes injury to another person that is defined as assault. Assault is divided into 3 separate degrees. The lowest level of Assault is Third Degree which is a Class A Misdemeanor. The next 2 degrees are determined by the seriousness of the injury to the victim and whether a weapon was used. Second Degree Assault is a Class D Violent Felony. Assault on a Police Officer is Second Degree Assault. Finally First Degree Assault is the highest degree which is classified and a Class B Violent Felony.

 

Repercussions for Assault in the Third Degree being a Class A Misdemeanor is up to 1 year in prison. Assault in the Second Degree being a Class D Violent Felony can result in up to 7 years in state prison. Assault in the First Degree being a Class B Violent Felony can result in up to 25 years in state prison and no less than 5 years even if there is no record of prior offenses.
